Welcome to the website of Professional MindCare Inc. ("we", "us", "our", or "the Company"), a corporation incorporated under the laws of Ontario, Canada. By accessing or using our website (the "Site") and purchasing any products or services offered through it, you ("Customer", "you", or "your") agree to be bound by these Terms and Conditions ("Terms").
 

If you do not agree with any part of these Terms, please discontinue your use of the Site immediately. These Terms apply to all visitors, users, and customers of the Site.
 

We reserve the right to update or modify these Terms at any time. Continued use of the Site following any changes constitutes acceptance of the revised Terms.

 

2. About Our Business
 

Professional MindCare Inc. is a mental health and workplace wellbeing brand offering:
 

  • Print-on-demand merchandise (mugs, tote bags, and related wellness products) fulfilled through Printful

  • Books and written publications available through our Site and/or Amazon

  • Digital content and resources related to mental health and professional wellbeing


We operate as an intermediary between our customers and third-party fulfillment and publishing platforms. By placing an order through our Site, you acknowledge and accept that fulfillment, shipping, and related services are carried out by these third-party partners.

 

3. Use of the Site
 

By using this Site, you represent that you are at least 18 years of age or the age of majority in your jurisdiction. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others.


You agree NOT to:

  • Use the Site for any fraudulent or unlawful purpose

  • Attempt to gain unauthorized access to any part of the Site

  • Reproduce, duplicate, or resell any part of our content without written permission

  • Transmit any harmful, offensive, or disruptive content through the Site


We reserve the right to terminate or restrict access to the Site for any user who violates these Terms.

 

4. Products and Pricing
 

4.1 Print-on-Demand Merchandise


Our merchandise (mugs, tote bags, and similar items) is produced on a print-on-demand basis by Printful Inc. This means products are individually created upon receipt of your order and are not pre-stocked. As a result:

  • Each item is custom-made specifically for you

  • Product colours may vary slightly from images displayed on the Site due to screen resolution differences

  • Production times are separate from shipping times


4.2 Books and Publications


Books and publications offered through our Site may be fulfilled directly by us or through Amazon's publishing and fulfillment services. Availability, delivery timelines, and pricing for books sold through Amazon are subject to Amazon's platform policies.


4.3 Pricing


All prices displayed on the Site are in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice. Applicable taxes (including HST where required) will be added at checkout based on your location. The final price, including taxes and shipping, will be displayed before you confirm your purchase.

5. Orders and Payment


By placing an order through our Site, you are making an offer to purchase the selected product(s). We reserve the right to accept or decline any order at our discretion.


Order confirmation does not guarantee product availability or shipment. In the unlikely event that an item cannot be fulfilled, you will be notified and offered a full refund.


Payment is processed securely through our third-party payment processors (Wix Payments, PayPal, or similar). Professional MindCare Inc. does not store, see, or have access to your financial or payment card information. By completing a purchase, you also agree to the terms and conditions of the applicable payment processor.

6. Shipping Policy


6.1 Print-on-Demand Products (Fulfilled by Printful)


Shipping of all print-on-demand merchandise is handled exclusively by Printful Inc. The following terms apply:

  • Shipping rates, delivery timelines, and available shipping methods are determined by Printful at the time of order

  • Estimated delivery times are provided by Printful and are not guaranteed by Professional MindCare Inc.

  • International shipping may be subject to customs duties, import taxes, and other fees imposed by the destination country, which are the sole responsibility of the customer

  • Printful ships to most countries worldwide; however, availability may vary

6.2 Books (Fulfilled by Amazon or Direct)


Books purchased through our Site or fulfilled via Amazon are subject to Amazon's shipping policies, including:

  • Delivery timelines as communicated at checkout on Amazon's platform

  • Amazon Prime eligibility where applicable

  • Shipping rates as determined by Amazon at the time of purchase

6.3 General Shipping Terms


Professional MindCare Inc. is not liable for delays caused by third-party carriers, customs processing, natural events, or other circumstances outside our control. Once an order has been dispatched by our fulfillment partner, responsibility for the shipment passes to the carrier.


If your order is lost in transit, please contact us and we will work with the relevant fulfillment partner to investigate and resolve the issue.

7. Return and Refund Policy


Because our products are produced on a print-on-demand basis and fulfilled by third-party partners, our return and refund policy reflects the policies of those partners. Please read this section carefully before making a purchase.


7.1 Print-on-Demand Products (Printful Policy)


As our merchandise is custom-made to order, we follow Printful's return and refund policy, which generally states:

  • Returns are NOT accepted for buyer's remorse, incorrect size selection, or change of mind, as each item is individually produced upon order

  • Refunds or replacements ARE provided by Printful in cases of: manufacturing defects, printing errors, damaged items received, or incorrect items shipped

  • Claims for defective or incorrect items must be submitted within 30 days of receiving the product, with photographic evidence

  • Printful does not refund or replace items due to customer-provided errors (e.g., incorrect address entered at checkout)


To initiate a claim for a defective or incorrect print-on-demand item, please contact us at the email provided in Section 13. We will liaise with Printful on your behalf to resolve the issue.

7.2 Books (Amazon Policy)


Returns and refunds for books fulfilled through Amazon are governed entirely by Amazon's return policy:

  • Physical books purchased through Amazon may be eligible for return within 30 days of delivery, subject to Amazon's standard return conditions

  • Kindle and digital books are subject to Amazon's digital content return policy

  • Condition of returned items must meet Amazon's return standards

7.3 Books Purchased Directly Through Our Site


For physical books purchased directly through our Site (not via Amazon):

  • Returns are accepted within 14 days of delivery, provided the book is in its original, unused condition

  • Return shipping costs are the responsibility of the customer unless the item was received damaged or incorrect

  • Refunds will be processed within 5-10 business days of receiving the returned item

  • Digital products and downloadable content are non-refundable once accessed or downloaded


7.4 How to Request a Refund or Return


To initiate a return or refund request for any product, please contact us with the following information:

  • Your full name and order number

  • Description of the issue

  • Photographs of the item (if applicable, e.g., defective or damaged products)


We will review your request and respond within 3-5 business days. Where the matter involves a third-party platform (Printful or Amazon), we will direct you to the appropriate process or assist you in initiating a claim.

8. Intellectual Property


All content on this Site, including but not limited to text, graphics, logos, product designs, images, and written publications, is the property of Professional MindCare Inc. or its content suppliers and is protected by applicable Canadian and international copyright, trademark, and intellectual property laws.


You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without prior written permission from Professional MindCare Inc.


Purchasing a product does not transfer any intellectual property rights to the customer. You receive a personal, non-exclusive right to use the purchased item for personal, non-commercial purposes.

Our Site may contain links to third-party websites or platforms including Printful, Amazon, Wix, and payment processors. These links are provided for your convenience only. Professional MindCare Inc. has no control over the content or practices of third-party sites and accepts no responsibility for them.


By using third-party platforms to complete your purchase or access services, you agree to be bound by their respective terms and conditions and privacy policies. We encourage you to review these before making any purchase or providing personal information:

The content, products, and messaging offered by Professional MindCare Inc. are intended for general awareness, wellness promotion, and educational purposes only. They do not constitute professional mental health advice, diagnosis, or treatment. 10.2 Product Disclaimer


While we take care to accurately represent our products, we cannot guarantee that product images on the Site are perfectly accurate representations of the physical items, due to variations in screen displays, printing processes, and material characteristics.


10.3 Limitation of Liability


To the fullest extent permitted by applicable law, Professional MindCare Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of, or inability to use, the Site or its products

  • Delays or errors in fulfillment, shipping, or delivery by third-party partners

  • Unauthorized access to or alteration of your data

Our total liability to you for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

For customers located in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws.
